Mustard Seed Center for Growth LLC dba One Mind Family respects your privacy.  THIS PRIVACY POLICY DESCRIBES HOW WE COLLECT AND USE PERSONAL INFORMATION. PLEASE READ IT CAREFULLY.
 

The websites and services provided through the website (“Site”) are provided by One Mind Family (“we,” “us” or “our”).  You (“you” or “your”) have a limited right to temporary, limited access and use the Site for your noncommercial, personal use, and information only.

WHAT INFORMATION DO WE COLLECT?

Information You Provide

Information that You Provide to Us. For example, you provide information when you: Fill out forms on the Site; Provide information to open an account; Communicate with us by phone, email or chat; Respond to surveys.
 

Some areas of the Site are available without opening an account. Other areas of the Site cannot be accessed without registering, which requires you to provide personal information to us. This personal information may include your:

Name; Address; Phone number; E-mail address

They do not collect or use any protected health information unless allowed by applicable law or consent. We do not control third parties’ collection or tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the provider directly.
 

If you would like to opt out from interest-based advertising, such as the targeting described above, or cross-context behavioral advertising, use the tools available at Digital Advertising Alliance WebChoices (https://optout.aboutads.info/) and/or Network Advertising Initiative’s opt-out (https://optout.networkadvertising.org/). Please note you may continue to receive generic ads.
 

You can also directly control cookie settings in the browser and disable cookies by following instructions provided by the supplier of the browser. Remember disabling cookies is browser specific. If you log on using one browser and disable cookies, you will also need to disable cookies in any other browser you use.

How We Use Information

We use information you provide and we collect to: Operate the Site; Provide the information and services requested; Administer the Site and diagnose problems with servers and networks; Secure the Site and other systems; Verify identity; Provide information about the Site and services; Assist you and help us perform responsibilities described in the Terms of Use; Analyze and measure visitors to the Site and how the Site is used in order to make the Site as useful as possible; To identify and advise of services offered that may be beneficial or of interest; Deliver customized content and advertising; Provide authorities or third parties with information related to the Site and its use; and Fulfill any other purpose for which you provide information.

How Do We Disclose Your Information

We will not sell or share (as defined by applicable law) personal information to anyone when not allowed by applicable law, but we may disclose information with others, such as our service providers, contractors, and other trusted associates, as necessary to operate our business or as otherwise permitted by law. If we disclose data to these third parties, such third parties are prohibited from using personal information except to provide these services to us and they are required to maintain the confidentiality of personal information.
 

We may also disclose personal information that we collect or you provide as described in this Privacy Policy: To our affiliates; To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our or any of our affiliates’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred; To third parties to promote or advertise products or services; To fulfill the purpose for which you provide it; For any other purpose disclosed by us when you provide the information; and/or With your consent.
 

We expect all collection, use and disclosure of information will occur in the United States and will be governed by United States law; however, some information may travel over the internet outside the United States. Even if information does travel outside the United States, you agree the laws of the United States apply.

What About Aggregated Data

We may disclose aggregated (combined) information about users of the Site that does not identify any individual or household without restriction. For example: We may aggregate data for product development and improvement activities and disclose such aggregated data to third parties; We may use information you provide to promote products or services of strategic partners but will not directly provide personally identifiable information to these strategic partners for promotional purposes.

What About Governmental & Legal Disclosures

We may also disclose personal information:

To comply with any court order, law, or legal process, including responding to any government or regulatory request.

To enforce or apply the Terms of Use and other agreements, including for billing and collection purposes.

To protect safety or the safety of others.

 

If we believe disclosure is necessary or appropriate to protect rights, property, or safety of our organization, affiliates, patients, users, or others. This includes exchanging information with third parties for these purposes, including fraud protection and credit risk reduction.

 

We will respond to any valid discovery request received from a government agency (i.e., HHS, DHS, or law enforcement agencies) without prior notice. Unless prohibited by law or by a valid court order, we will attempt to notify you of any valid discovery request received from any other party (i.e., for civil litigation) which requires us to disclose identity and will wait five (5) business days, or a lesser amount of time as required by the deadline in the discovery request, before providing the information requested by the discovery request.

What About Do Not Track

Websites and web applications can track movements on the internet to better tailor suggestions for you based on interests. We may track movement through the Site and across third party websites to provide targeted content, and therefore we do not respond to Do Not Track (DNT) signals. However, some people do not want browsing behavior to be tracked. Your web browser allows you to set the DNT signal on the browser so third parties (particularly advertisers) know you do not want to be tracked. We also suggest reading the privacy policies of third-party websites to see if those websites track browsing. Information gathered using tracking technology will be used and disclosed as described in this Privacy Policy, and policies of the applicable privacy policies.

What About Compliance With COPPA

The Site is not directed at children under the age of 13. We comply with the Children’s Online Privacy Protection Act (“COPPA”) and do not knowingly permit registration or submission of personally identifiable information by anyone under 13. This age requirement is posted each time we request personally identifiable information. If you believe information of a child under 13 has been submitted by a child under 13, please advise us via email and we will investigate and delete it.

What About International Privacy Laws

If visiting websites from outside the United States, please be aware you are sending information (including personal information or personal data) to the United States, where our servers are located. That information may then be transferred within the United States or back outside the United States to other countries.

All data collected by or through the Site will be stored in secure hosting facilities contracted by us or service providers. We have data processing agreements in place with service providers consistent with applicable privacy and data security laws.
 

One Mind Family is located in, and provide services entirely within, the United States, and is governed by United States law. For visitors from the European Union and European Economic Area, countries outside of the EU (such as the United States) may not have data protection laws as comprehensive or protective as those in your country. The United States has not been issued an adequacy decision finding the data privacy laws to provide an adequate level of protection. Therefore, collection and transfer of data will occur on one of the following bases, depending on the type of transfer and the surrounding factual situation:
 

The transfer is necessary for performance of a contract between you and One Mind Family. This will apply when, for example, buying a product or signing up for information.

The transfer is necessary for conclusion or performance of a contract between One Mind Family and another person or entity, that is in your interest. This will apply when, for example, you request a product or further information from a third party through the Site.
 

The transfer is necessary for establishment, exercise, or defense of legal claims. This would apply if there developed a dispute between you and One Mind Family.

You consent to the transfer, having been informed of the possible risks of the transfer.  This paragraph explains possible risks: while we exercise great care to protect personal information and personal data, it is possible we may be required to produce personal data to U.S. legal authorities upon presentation of a discovery request, court order, search warrant, or other legal process.  We will evaluate the legal process and object to such legal demands when allowed unless it is clearly valid based on the legal opinion of our attorneys. The data protection laws in the United States may also provide for other uses of data, including uses for marketing that differ from the use for which the data was originally collected (“secondary uses”); however, except where otherwise compelled by law, collection, storage, and use of personal data as provided or use through the Site will at all times continue to be governed by this Privacy Policy, as it may exist from time to time.

What About Marketing Or Other Communication Use

You agree we can process information you provide to us and use it to assist you in making an appointment, providing other services, or for future marketing or communication purposes as permitted by law.

How Secure Is The Site

The Site has security measures in place to protect against the loss, misuse or alteration of information under our control. However, no security is perfect or 100% effective, and no security system can prevent security breaches. You transmit information to us at your own risk. You acknowledge the Site is not HIPAA or FERPA compliant. You should not store or transmit nonpublic information, protected health information, nonpublic personal information, personally identifiable information, student records, education records, or other confidential information on this Site. You acknowledge and agree the Site is not intended to provide any medical advice, recommendation, treatment, or services. We are not your business associate under HIPAA as a result of use of the Site.

How Can This Policy Be Changed

We may update the Privacy Policy from time to time, and we will provide notice of any such changes to the Privacy Policy as required by law. The date the Privacy Policy was last updated is identified at the top of this page. We encourage you to periodically review the Privacy Policy to remain informed of how we use and protect your information. Our use of information gathered or obtained is subject to the Privacy Policy in effect at the time of such use.

What If My Information Is Wrong

You may write or email us if you believe information you have submitted to us through the Site is incorrect. We may not be able to correct that information, because, for example, we did not save the information, or because we do not yet have a process to update the information.

Can I Get A Copy Of My Information

You may write or email us to request a copy of the information you have submitted or we have collected about you through the Site. If we are able to collect and provide the information, we will do so. In some cases, we may not be able to collect and provide the information, because of the way the data is used and stored.
